Outcomes and Sanctions

Level 1 sanctions can include, but are not limited to:

  • Accountability Meeting(s) – These check-in and follow-up meetings will be with various campus offices and/or other identified professionals on campus that you could learn how to utilize resources that may help you learn more on accountability in regards to your actions and consequences to those actions.
  • Alcohol and Other Drug (AOD) Counseling Assessment - An evaluation/intervention with a counselor in the Health & Counseling Center. You are required to follow up on any further recommendations made. Please contact the Counseling Services Center office at (315) 279-5368, or by stopping by the office on the first floor of the Keuka Commons. Counseling Services will confirm if/when this is complete. An initial intake assessment/treatment can also be obtained by contacting Finger Lakes Addictions Counseling & Referral Agency (FLACRA) at (315) 536-7751. The results of the assessment need to be shared with the Director of Community Standards & Student Intervention as verification of completion. During your assessment/treatment, please complete a signed release form giving permission for the individual completing the assessment/treatment to verify completion. You must comply with any recommendations made for further assessment or treatment.
  • AlcoholEdu for Sanctions – An online alcohol education program.
  • Campus Service – A number of hours of community service done on the College campus. You must submit a proof of completion by submitting a "Community Service Form" which is attached to the outcome letter.
  • Community Service - A number of hours of community service (volunteer work) done in the community of choice. You must submit a proof of completion by submitting a "Community Service Form" which is attached to the outcome letter.
  • Counseling Assessment - An evaluation/intervention with a counselor in the Health & Counseling Center. You are required to follow up on any further recommendations made. Please contact the Counseling Services Center office at (315) 279-5368, or by stopping by the office on the first floor of the Keuka Commons. Counseling Services will confirm if/when this is complete.
  • Educational Sanction - A sanction designed to provide an additional educational opportunity for a student who has been found responsible for violating the Student Code of Community Standards.
  • Letter of Apology – A written or verbal expression of remorse and the willingness to take responsibility for a transgression that is extended to an individual who was inconvenienced, insulted or otherwise harmed by the respondent’s behavior. As you draft your letter, please reflect and address the following questions -- (1) What happened? (2) What was your role/responsibility? (3) How do you feel about the harm caused? (4) What will be your behavior in the future? (5) What amends will you make to repair harm/rebuild trust?
  • Parental or Guardian Notification - Parents may be notified regarding alcohol and drug violations for which the student is found responsible.
  • Reflection Paper – A written expression of this incident to address the following (4) pieces of criteria; 1. Do you take personal responsibility for your conduct? Can you identify key strategies to redefine your behavior in avoiding recidivism?, 2. What are some support services and resources (both offered directly by the institution, and indirectly with partnering agencies) in order to seek further assistance?, 3. What do you feel are the implications of your conduct and harm caused to others?, and 4. Why might the Keuka College community be concerned about your conduct? Reflect on differences between your values, the institutions values, and your actions.
  • Residence Hall or Apartment Relocation – You are required to move from your current housing assignment to a new housing assignment.
  • Responsible Decision Making Workshop – A campus program or session conducted by a faculty or staff member around health and wellness, interpersonal skills building, etc. Attendance will be taken for verification of completion of the workshop. This workshop will be conducted in person, unless otherwise noted.
  • Restitution - Money assessed to students for damage done to an individual or College property. Damages may be assessed to individuals who have been found responsible for the damage and/or to a group of individuals. Damages not associated with specific individuals may be billed to a hall, building, or organization. This money is paid to Keuka College by students who have been found responsible for specific violations of the Student Code of Community Standards or other College policies.
  • Substance Workshop – A 60-minute class held on campus at 6:00 p.m. This workshop is conducted by a staff member from the Council on Alcoholism and Addictions of the Finger Lakes. Attendance will be taken for verification of completion of the workshop. This workshop will be conducted in person, unless otherwise noted.
  • Written Reprimand & Warning - An official notice by a Community Standards Administrator or panel member to a student who has violated College policy, indicating that should the behavior in question continue, additional disciplinary action will be taken.

Level 1 sanctions cannot be appealed, absent of procedural error.

Level 2 sanctions are (listed in order of severity from lowest to highest):

  • Campus Restriction
  • Disciplinary Probation
  • Deferred Suspension
  • Removal from Housing
  • Suspension
  • Expulsion

Level 2 sanctions can be appealed based on the following criteria:

  • Appropriateness of Sanction(s) - The sanction(s) imposed are substantially inconsistent with the severity of violation(s).
  • New Evidence - New evidence, which was unknown or unavailable during the original hearing, that could substantially impact the original finding or sanction. A summary of this new evidence and its potential impact must be included.
  • Review of Procedures - A procedural error or omission occurred that significantly impacted the outcome of the hearing (e.g. substantiated bias, material deviation from established procedures, etc.).

Section A - Way of the Wolf

  • A.1 -- Respect, Appreciation, and Care for diversity in people, culture, beliefs, ideas, practices, and experiences.
  • A.2 -- Integrity in pursuit of personal and academic excellence.
  • A.3 -- Social Responsibility and Leadership as a local, national, and global citizen.

The following sanctions for violations of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

Accountability Meeting(s)

  • Through meeting(s) with key resources on campus, you will learn how to utilize resources that may help you learn more on accountability in regards to your actions and consequences to those actions. It is the hope that these meetings may help you to utilize resources to keep your GPA up, find activities to occupy your time in a productive manner and illustrate the responsibility to yourself, your peers, and your current college experience

Reflection Paper

You are to complete a 2-page Reflection Paper. It is to be single-spaced with (12) Point/Times New Roman font. In writing this paper be sure to address the following (4) pieces of criteria:

  • Do you take personal responsibility for your conduct? Can you identify key strategies to redefine your behavior in avoiding repeating this behavior?
  • What are some support services and resources (both offered directly by the institution, and indirectly with partnering agencies) in order to seek further assistance?
  • What do you feel are the implications of your conduct and harm caused to others?
  • Why might the Keuka College community be concerned about your conduct? Reflect on differences between your values, the Way of the Wolf, and your actions.

Section B - Safety and Student Wellness

  • B.1 -- Knowingly supplying false information.
  • B.2 -- Forgery, alteration, or misuse of Keuka College documents, records, or identification.
  • B.3 -- Disruption, interference, tampering with Keuka College activities, events, or functions.
  • B.4 -- Unauthorized representation of Keuka College.
  • B.5 -- Possession or use of keys to College facilities without proper authorization.
  • B.6 – Entering, using, or exiting Keuka College property or facilities contrary to directives or published policy.
  • B.7 -- Failure to comply with the directives of Keuka College authorized staff.
  • B.8 -- Disrespect/verbal abuse.
  • B.9 -- Lewd or indecent behavior.
  • B.10 -- Participation in a campus demonstration that disrupts the operations of Keuka College.
  • B.11 -- Theft (includes all forms of larceny, burglary, robbery, motor vehicle theft, etc.).
  • B.12 -- Violation of motor vehicle/student vehicle/parking & traffic regulation(s).
  • B.13 -- Conduct that is in violation of federal, state, or local law.
  • B.14 -- Possession, use, or distribution of fireworks, weapons, and noxious materials.
  • B.15 -- Behavior that threatens the security of the College community, buildings, or facilities.
  • B.16 -- Causing physical harm.
  • B.17 -- Coercing, detaining, threatening physical harm, endangering the health or safety of any member of campus or the external community.
  • B.18 -- Threatening, harassing, hazing, bullying, intimidating or seeking to intimidate any member of campus or the external community.
  • B.19 -- Engaging in behavior which poses a significant interference to campus life.
  • B.20 -- Vandalism, damage to/destruction of property.
  • B.21 – Murder and Non-Negligent Manslaughter.
  • B.22 -- Negligent Manslaughter.
  • B.23 -- Aggravated Assault.
  • B.24 -- Stalking.
  • B.25 -- Retaliation.
  • B.26 -- Gambling

The following sanctions for violations, B.1 through B. 12 and B.26, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Disciplinary probation for one semester
  • Two hours of campus or community service
  • Letter of Apology & Reflection, if applicable

Second Violation:

  • Disciplinary probation for two semesters
  • Four hours of campus or community service
  • Letter of Apology & Reflection, if applicable
  • Reflection Paper

Third or Additional Violations:

  • Deferred Suspension for a set period of time
  • Eight hours of campus or community service
  • Counseling Assessment

The following sanctions for violations, B.13 through B.25, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Deferred Suspension for a set period of time
  • Four hours of campus or community service
  • Counseling Assessment
  • Responsible Decision Making Workshop

Second Violation:

  • Suspension for one semester
  • Counseling Assessment
  • Responsible Decision Making Workshop

Third or Additional Violations:

  • Suspension for two consecutive semesters
  • Counseling Assessment
  • Responsible Decision Making Workshop

Section C - Alcohol, Tobacco & Other Drugs Policy

Section C.1 - Alcohol Policy

  • C.1.1 -- Public Intoxication/Drunkenness.
  • C.1.2 -- Alcohol in Public View.
  • C.1.3 -- Selling, offering, delivering or supplying alcoholic beverages to persons under 21.
  • C.1.4 -- Consumption of alcohol under the legal drinking age.
  • C.1.5 -- Possession or acquisition of alcohol under the legal drinking age.
  • C.1.6 -- Being in the presence of alcohol while under the legal drinking age.
  • C.1.7 -- “Of-Age” consumption of alcohol with person(s) under the legal drinking age present.
  • C.1.8 -- Possession of common containers or alcohol paraphernalia.
  • C.1.9 -- Participating in drinking games or contests.
  • C.1.10 -- Beer or alcohol containers and alcohol-themed decorations that are visible from the window(s) of your living space.

The following sanctions for violations, C.1.1 through C.1.10, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Alcohol.Edu for Sanctions (an online education course)
  • Two hours of campus or community service
  • Parental notification for any underage studen

Second Violation:

  • Alcohol.Edu for Sanctions (an online education course), if appropriate
  • Substance Workshop
  • Alcohol and Other Drug (AOD) Counseling Assessment (one-hour session)
  • Four hours of campus or community service
  • Parental notification for any underage student

Third Violation:

  • Disciplinary Probation for two consecutive semesters
  • Referral for assessment/education or treatment at:
    • Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
    • Keuka College’s Health & Counseling Center
    • The student must comply with any recommendations made for further assessment, education, or treatment.
  • Parental notification for any underage student

Fourth or Additional Violation(s):

  • Removal from residence halls or Suspension from the College for one semester
  • Referral for assessment/education or treatment at:
    • Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
    • Health & Counseling Center at Keuka College
    • The student must comply with any recommendations made for further assessment, education, or treatment.
  • Parental notification for any underage student

Section C.2 - Tobacco Policy

  • C.2.1 -- Smoking or vaping inside any College building or facility.
  • C.2.2 -- Smoking or vaping within 50 feet of any College building or facility.
  • C.2.3 -- Smoking or vaping inside any College-owned vehicle.
  • C.2.4 -- Tobacco-themed decorations that are visible from the window(s) of your living space.

The following sanctions for violations, C.2.1 through C.2.4, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Fire Safety & Tobacco/Vaping for Sanctions (an online education course or materials)
  • Disciplinary Probation for one semester

Second Violation:

  • Fire Safety & Tobacco/Vaping for Sanctions (an online education course or materials), if appropriate
  • Disciplinary Probation for two consecutive semesters

Third or Additional Violation(s):

  • Deferred Suspension for 1 semester
  • Referral for assessment/education or treatment at:
    • Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
    • Keuka College’s Health & Counseling Center
    • The student must comply with any recommendations made for further assessment, education, or treatment.

Section C.3 - Other Drugs Policy

  • C.3.1 -- Purchase, use, selling, distribution, cultivation, or possession of cannabis, or derivatives of cannabis.
  • C.3.2 -- Purchase, use, selling, distribution, cultivation, or possession of narcotics, hallucinogens, synthetic drugs, illegal drugs.
  • C.3.3 -- Selling, giving, offering, or distributing prescription drugs.
  • C.3.4 -- Manufacturing, selling, giving, offering, or distribution of illegal drugs.
  • C.3.5 -- Possession of illegal drug paraphernalia.
  • C.3.6 -- Being in the presence of illegal drugs.
  • C.3.7 -- Cannabis- or drug-themed decorations that are visible from the window(s) of your living space.

The following sanctions for violations, C.3.1 through C.3.7, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • HE Prescription Drug Abuse (an online education course) or another drug education course
  • Substance Workshop
  • Alcohol and Other Drug (AOD) Counseling Assessment (one-hour session)
  • Disciplinary Probation for two consecutive semesters
  • Parental notification at discretion of hearing officer

Second Violation:

  • HE Prescription Drug Abuse (an online education course) or another drug education course, if appropriate
  • Substance Workshop
  • Parental notification
  • Referral for assessment/education or treatment at:
    • Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
    • Health & Counseling Center at Keuka College
    • The student must comply with any recommendations made for further assessment, education, or treatment.
  • Deferred Suspension for two consecutive semesters

Third or Additional Violation(s):

  • Referral for assessment/education or treatment at:
    • Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
    • Health & Counseling Center at Keuka College
    • The student must comply with any recommendations made for further assessment, education, or treatment.
  • Parental notification
  • Suspension for two consecutive semesters
  • Expulsion, if appropriate

Section D - Information Technology & Communications

  • D.1 -- Violation of copyright laws.
  • D.2 -- Violation of the acceptable user/network policy and/or College computer facilities.

The following sanctions for violations of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First or Additional Violation(s):

  • The Community Standards Administrator will determine appropriate sanctions in consultation with the Information Technology office.

Section E - Fire Safety Policy

  • E.1 -- Creating a Fire hazard.
  • E.2 -- Failing to promptly vacate any building when any fire emergency system is activated.
  • E.3 -- Starting, attempting to start, or tending a fire without appropriate authorization.
  • E.4 -- Falsely reporting a fire or incendiary device.
  • E.5 -- Possession, distribution, or use of fireworks, explosives, incendiaries, etc.
  • E.6 -- Tampering with fire safety equipment.
  • E.7 -- Arson.

The following sanctions for violations, E.1 through E.2, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Fire Safety & Tobacco/Vaping for Sanctions (an online education course or materials)

Second Violation:

  • Fire Safety & Tobacco/Vaping for Sanctions (an online education course or materials)
  • Disciplinary Probation for one semester

Third or Additional Sanction(s):

  • Disciplinary Probation for two semesters
  • Accountability Meeting(s)
  • Responsible Decision Making Workshop

Note: Students should expect enhanced sanctioning if the incident is the result of alcohol intoxication or drug impairment.

The following sanctions for violations, E.3 through E.7, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

 First Violation:

  • Deferred Suspension for two consecutive semesters
  • Accountability Meeting(s)
  • Responsible Decision Making Workshop

Second Violation:

  • Suspension for two consecutive semesters
  • Expulsion, if applicable

Note: Students should expect enhanced sanctioning if the incident is the result of alcohol intoxication or drug impairment.

Section F: Gender and Sex-Based Harassment and Sexual Misconduct

  • F.1 -- Sexual Harassment.
  • F.2 -- Gender-Based Harassment.
  • F.3 -- Intimate Partner Violence.
    • F.3.1 -- Dating Violence.
    • F.3.2 -- Domestic Violence.
  • F.4 -- Sexual Assault.
    • F.4.1 -- Non-Consensual Sexual Intercourse/Rape.
    • F.4.2 -- Non-Consensual Sexual Contact/Fondling.
    • F.4.3 -- Statutory Rape.
    • F.4.4 -- Sexual Assault due to incapacitation.
      • F.4.4.a -- Alcohol.
      • F.4.4.b -- Drugs.

Section G - Residence Halls & Apartments

  • G.1 -- Violation of the Housing Agreement.
  • G.2 -- Unauthorized Room Change/Hall/Apartment Transfer.
  • G.3 -- Student Visitation/Guest Policy.
  • G.4 -- Occupancy Policy.
  • G.5 -- Courtesy & Quiet Hours Policy.
  • G.6 -- Appliance/Prohibited Item Policy.
  • G.7 -- Solicitation of Goods/Services.
  • G.8 -- General Uncleanliness.
  • G.9 -- Pet(s) Policy.
  • G.10 -- Damage to a common/public area.
  • G.11 -- Removal of College property from common/public spaces.
  • G.12 -- Hall Sports.
  • G.13 -- Window/Roof/Ledge/Exterior Access.
  • G.14 -- Check-in and Check-out Procedures.

The following sanctions for violations, G.1 through G.8, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Written Reprimand & Warning

Second Violation:

  • Two hours of campus or community service

Third or Additional Violation(s):

  • Campus Restriction - Loss of Guest Privileges for one semester
  • Disciplinary Probation for up to two consecutive semesters

  • Responsible Decision Making Workshop

The following sanctions for violations, G.9 through G.14, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First Violation:

  • Two hours of campus or community service
  • Reflection Paper
  • Responsible Decision Making Workshop
  • Removal of pet within 24 hours, if applicable
  • Restitution, if applicable

Second Violation:

  • Campus Restriction - Loss of Guest Privileges for two semesters, etc., if applicable
  • Disciplinary Probation for up to two consecutive semesters
  • Four hours of campus or community service
  • Reflection Paper
  • Responsible Decision Making Workshop
  • Removal of pet within 24 hours, if applicable
  • Restitution, if applicable

Third or Additional Violation(s):

  • Deferred Suspension for one semester
  • Removal from housing, if applicable
  • Six hours of campus or community service
  • Reflection Paper
  • Responsible Decision Making Workshop
  • Removal of pet within 24 hours, if applicable
  • Restitution, if applicable

Section H - Community Standards Hearing & Appeal Process Infractions

  • H.1 -- Failure to comply with the sanctions imposed through the Community Standards process.
  • H.2 -- Falsification, distortion, or misrepresentation of information in the Community Standards process.
  • H.3 -- Discouraging or attempting to discourage an individual’s participation in a Community Standards Hearing.
  • H.4 -- Harassment, intimidation, or attempting to intimidate a Community Standards Administrator or Community Standards Panel member.
  • H.5 -- Violation of a No Contact Order.

The following sanctions for violations, H.1 through H.5, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First or Additional Violation(s):

  • The original sanction(s) would increase to the next level of violation within that policy.

Section I - COVID-19 & Immunization Policies

  •  I.1 -- COVID-Positive Intentional Violations
  • I.2 -- Failure to Self-Isolate
  • I.3 -- Failure to Quarantine
  • I.4 -- Face Mask and Social Distancing Requirements
  • I.5 -- Failure to Comply with Immunization Policy
  • I.6 -- Failure to Comply with Campus Health Protocols

The following sanctions for violations, I.1 through I.6, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First or Additional Violation(s):

  • Permanent dismissal or suspension from academic access (including distance learning) and housing for no less than one academic semester.

Section J : Harassment/Bias Related Offenses

  • J.1 -- Discriminatory Harassment.
    • J.1.a. -- Verbal.
    • J.1.b -- Physical.
    • J.1.c -- Denies access and or opportunity.
    • J.1.d -- Other.
  • J.2 -- Intimidation.
    • J.2.a -- Verbal.
    • J.2.b -- Physical.
    • J.2.c -- Cyber.
    • J.2.d -- Other.

The following sanctions for violations, J.1 through J.2.d, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First or Additional Violation(s):

  • The Director of Community Standards & Student Intervention will determine appropriate sanctions in consultation with the Title IX Coordinator and/or their designee.

Section K: Minors/Mandated Reporting

  • K.1 -- Reporting failure.
  • K.2 -- Cause harm (beyond physical).

The following sanctions for violations, K.1 through K.2, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.

First or Additional Violation(s):

  • The Director of Community Standards & Student Intervention will determine appropriate sanctions in consultation with the Title IX Coordinator and/or their designee.

Incomplete Sanctions

If sanctions are not completed by the assigned deadline, the conduct hearing officer or their designee will:

  • Offer a revised due date of up to 10 days upon receipt of the incomplete sanction letter.
  • If the revised due date is not met, the original sanction(s) would increase to the next level of violation within that policy.
