Level 2 sanctions can be appealed based on the following criteria:
●
Appropriateness of Sanction(s) - The sanction(s) imposed are substantially inconsistent with the severity of violation(s).
●
New Evidence - New evidence, which was unknown or unavailable during the original hearing, that could substantially impact the original finding or sanction. A summary of this new evidence and its potential impact must be included.
●
Review of Procedures - A procedural error or omission occurred that significantly impacted the outcome of the hearing (e.g. substantiated bias, material deviation from established procedures, etc.).
Section A - Way of the Wolf

The following sanctions for violations of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
Accountability Meeting(s)
▪ Through meeting(s) with key resources on campus, you will learn how to utilize resources that may help you learn more on accountability in regards to your actions and consequences to those actions. It is the hope that these meetings may help you to utilize resources to keep your GPA up, find activities to occupy your time in a productive manner and illustrate the responsibility to yourself, your peers, and your current college experience.
Reflection Paper
▪ You are to complete a 2-page Reflection Paper. It is to be single-spaced with (12) Point/Times New Roman font. In writing this paper be sure to address the following (4) pieces of criteria:
▪ Do you take personal responsibility for your conduct? Can you identify key strategies to redefine your behavior in avoiding repeating this behavior?
▪ What are some support services and resources (both offered directly by the institution, and indirectly with partnering agencies) in order to seek further assistance?
▪ What do you feel are the implications of your conduct and harm caused to others?
▪ Why might the Keuka College community be concerned about your conduct? Reflect on differences between your values, the Way of the Wolf, and your actions.
Section B - Safety and Student Wellness
● B.1 -- Knowingly supplying false information.
● B.2 -- Forgery, alteration, or misuse of Keuka College documents, records, or identification.
● B.3 -- Disruption, interference, tampering with Keuka College activities, events, or functions.
● B.4 -- Unauthorized representation of Keuka College.
● B.5 -- Possession or use of keys to College facilities without proper authorization.
● B.6 -- Entering Keuka College property or facilities contrary to directives or published policy.
● B.7 -- Failure to comply with the directives of Keuka College authorized staff.
● B.8 -- Disrespect/verbal abuse.
● B.9 -- Lewd or indecent behavior.
● B.10 -- Participation in a campus demonstration that disrupts the operations of Keuka College.
● B.11 -- Theft (includes all forms of larceny, burglary, robbery, motor vehicle theft, etc.).
● B.12 -- Violation of motor vehicle/student vehicle/parking & traffic regulation(s).
● B.13 -- Conduct that is in violation of federal, state, or local law.
● B.14 -- Possession, use, or distribution of weapons.
● B.15 -- Behavior that threatens the security of the College community, buildings, or facilities.
● B.16 -- Causing physical harm.
● B.17 -- Coercing, detaining, threatening physical harm, endangering the health or safety of any member of campus or the external community.
● B.18 -- Threatening, harassing, hazing, bullying, intimidating or seeking to intimidate any member of campus or the external community.
● B.19 -- Engaging in behavior which poses a significant interference to campus life.
● B.20 -- Vandalism, damage to/destruction of property.
● B.21 – Murder and Non-Negligent Manslaughter.
● B.22 -- Negligent Manslaughter.
● B.23 -- Aggravated Assault.

The following sanctions for violations, B.1 through B. 12, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
First Violation:

Section C.1 - Alcohol Policy
● C.1.1 -- Public Intoxication/Drunkenness.
● C.1.2 -- Alcohol in Public View.
● C.1.3 -- Selling, offering, delivering or supplying alcoholic beverages to persons under 21.
● C.1.4 -- Consumption of alcohol under the legal drinking age.
● C.1.5 -- Possession or acquisition of alcohol under the legal drinking age.
● C.1.6 -- Being in the presence of alcohol while under the legal drinking age.
● C.1.7 -- “Of-Age” consumption of alcohol with person(s) under the legal drinking age present.

▪ Removal from residence halls or Suspension from the College for one semester
▪ Referral for assessment/education or treatment at:
▪ Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
▪ Health & Counseling Center at Keuka College
▪ The student must comply with any recommendations made for further assessment, education, or treatment.
▪ Parental notification for any underage student
Section C.2 - Tobacco Policy
● C.2.1 -- Smoking or vaping inside any College building or facility.
● C.2.2 -- Smoking or vaping within 50 feet of any College building or facility.
● C.2.3 -- Smoking or vaping inside any College-owned vehicle.
● C.2.4 -- Tobacco-themed decorations that are visible from the window(s) of your living space.
The following sanctions for violations, C.2.1 through C.2.4, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
First Violation:
▪ Fire Safety & Tobacco/Vaping for Sanctions (an online EVERFI education course)
▪ Disciplinary Probation for one semester
Second Violation:
▪ Fire Safety & Tobacco/Vaping for Sanctions (an online EVERFI education course), if appropriate
▪ Disciplinary Probation for two consecutive semesters
Third or Additional Violation(s):
▪ Deferred Suspension for 1 semester
▪ Referral for assessment/education or treatment at:
▪ Finger Lakes Addictions Counseling and Referral Agency (FLACRA)
▪ Keuka College’s Health & Counseling Center
▪ The student must comply with any recommendations made for further assessment, education, or treatment.
Section C.3 - Other Drugs Policy
● C.3.1 -- Purchase, use, selling, distribution or possession of cannabis, or derivatives of cannabis.
● C.3.2 -- Purchase, use, selling, distribution or possession of narcotics, hallucinogens, synthetic drugs, illegal drugs.
● C.3.3 -- Selling, giving, offering, or distributing prescription drugs.
● C.3.4 -- Manufacturing, selling, giving, offering, or distribution of illegal drugs.
● C.3.5 -- Possession of illegal drug paraphernalia.
● C.3.6 -- Being in the presence of illegal drugs.
● C.3.7 -- Cannabis- or drug-themed decorations that are visible from the window(s) of your living space.
The following sanctions for violations, C.3.1 through C.3.7, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
First Violation:
▪ HE Prescription Drug Abuse (an online EVERFI education course) or another drug education course
▪ Substance Workshop
▪ Alcohol and Other Drug (AOD) Counseling Assessment (one-hour session)
▪ Disciplinary Probation for two consecutive semesters
▪ Parental notification at discretion of hearing officer
Second Violation:
▪ HE Prescription Drug Abuse (an online EVERFI education course) or another drug education course, if appropriate

Section D - Information Technology & Communications
● D.1 -- Violation of copyright laws, user/network policy, or College computer facilities.
The following sanctions for violations of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
First or Additional Violation(s):
▪ The Conduct Hearing Officer will determine appropriate sanctions in consultation with the Information Technology office.
Section E - Fire Safety Policy
● E.1 -- Creating a Fire hazard.
● E.2 -- Failing to promptly vacate any building when any fire emergency system is activated.
● E.3 -- Starting, attempting to start, or tending a fire without appropriate authorization.
● E.4 -- Falsely reporting a fire or incendiary device.
● E.5 -- Possession, distribution, or use of fireworks, explosives, incendiaries, etc.
● E.6 -- Tampering with fire safety equipment.
● E.7 -- Arson.
The following sanctions for violations, E.1 through E.2, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
First Violation:

First Violation:

Section H - Community Standards Hearing & Appeal Process Infractions
● H.1 -- Failure to comply with the sanctions imposed through the Community Standards process.
● H.2 -- Falsification, distortion, or misrepresentation of information in the Community Standards process.
● H.3 -- Discouraging or attempting to discourage an individual’s participation in a Community Standards Hearing.
● H.4 -- Harassment, intimidation, or attempting to intimidate a Community Standards Administrator or Community Standards Panel member.
● H.5 -- Violation of a No Contact Order.
The following sanctions for violations, H.1 through H.5, of this policy are guidelines; sanctions may vary on a case-by-case basis and are proportionate with the severity of the violation committed, the past and current history of violations, and will become progressively more severe if the student engages in further violations.
First or Additional Violation(s):

▪ Permanent dismissal or suspension from academic access (including distance learning) and housing for no less than one academic semester.

First or Additional Violation(s):

Incomplete Sanctions
If sanctions are not completed by the assigned deadline, the conduct hearing officer or their designee will:

Offer a revised due date of up to 10 days upon receipt of the incomplete sanction letter.
●
If the revised due date is not met, the original sanction(s) would increase to the next level of violation within that policy.
